September VP Smooth Parts Sweepstakes Rules (“Official Rules”)

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. MAKING A PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING. VOID ANYWHERE ELSE WHERE PROHIBITED.

1. Eligibility: The VP Smooth Parts Sweepstakes is open to permanent legal U.S. residents physically residing in the 50 United States and Washington D.C. Entrants must be 18 years of age or older as of their date of entry in this promotion in order to qualify. THE SWEEPSTAKES ARE VOID WHERE PROHIBITED OR RESTRICTED BY LAW OR WHERE BONDING, REGISTRATION, OR OTHER REQUIREMENTS WOULD BE REQUIRED BUT HAVE NOT BEEN MET. ALL APPLICABLE FEDERAL, STATE AND LOCAL LAWS APPLY. Shapeways’ employees, subsidiaries, affiliates, suppliers, partners, advertising and promotion agencies, and directors (collectively the “Employees”), as well as members of an Employees’ immediate family and/or those living in the same household of Employees are ineligible to participate in the VP Smooth Parts Sweepstakes.

2. Sponsorship. The VP Smooth Parts Sweepstakes are sponsored by Shapeways, Inc. (“Sponsor” or “Shapeways”), located at 228 Park Avenue S, PMB 15839, New York, NY 10003. Sponsor will conduct the Sweepstakes substantially as described in these Official Rules.

3. Agreement to Rules: By entering this Sweepstakes, the Entrant (“You”) agrees to abide by the Sponsor’s Official Rules and decisions, which are fully and unconditionally binding in all respects. The Sponsor reserves the right to refuse, withdraw, or disqualify any entry at any time at the Sponsor’s sole discretion. By entering this Sweepstakes, you represent and warrant that You are eligible to participate based on eligibility requirements explained in the Official Rules. You also agree to accept the decisions of the Sponsor as final and binding as it relates to the content of this VP Smooth Parts Sweepstakes. Sponsor reserves the right to modify these Official Rules in any way or at any time.

4. VP Smooth Parts Sweepstakes Entry Period: This promotion begins on September 1, 2021 at 12:00 AM EST and ends on September 30, 2021 at 11:59 PM EST (“Entry Period”). To be eligible for the Sweepstakes, entries must be received within the specified Entry Period.

5. How to Enter: No purchase or payment is necessary to participate in the Sweepstakes. During the Entry Period, you automatically receive one entry when you 1) add a new follow on one of Shapeways’ social media accounts (LinkedIn, Instagram, Facebook, and Twitter); maximum of 4 entries per applicant, and 2) leave a comment on the VP Smooth Parts Sweepstakes post. You can also receive a bonus entry by subscribing to Shapeways’ marketing newsletter. As a participant, your entry must fully meet all Sweepstakes requirements, as specified in these Official Rules, in order to be eligible to win a prize. Incomplete entries or those that do not adhere to these Official Rules or specifications will be disqualified at the Sponsor’s sole discretion. Fraudulent methods of entry or circumvention of the rules may result in the Sponsor invalidating your entries and removing them from the Sweepstakes at the Sponsor’s sole discretion.

6. Prizes: The Winner of the VP Smooth Parts Sweepstakes (the “Winner”) will receive Shapeways credit in the amount of $500.00 USD applicable to orders placed in our VP Smooth material (the ”Prize”). A Shapeways account is required to receive and redeem the Prize. The Prize must be redeemed in a single order before December 31, 2021, and any unused balance of the Prize will be lost. There shall be no cash or other prize substitution permitted except at the Sponsor’s discretion. The prize is non-transferable. The Winner, upon acceptance of the prize, is solely responsible for all expenses related to the prize, including without limitation any and all local, state, and federal taxes. The Winner shall not transfer assignment of the prize to others nor shall the Winner request the cash equivalent or prize substitution. By accepting the prize, the selected Winner grants permission for the Sponsor to use the Winner’s likeness, entry, and name for purposes of advertising and trade without further compensation unless prohibited by law. The Winner shall be responsible and liable for all federal, state, and local taxes on the value of the Prize, and any applicable forms and/or filings (including without limitation a form 1099). To receive a complete list of winners or a copy of these Official Rules, within six (6) months after the end of the Entry Period, send a self-addressed stamped envelope to September VP Smooth Parts Sweepstakes, Sweepstakes Winners List, 228 Park Avenue S, PMB 15839, New York, NY 10003.

7. Odds: The total number of eligible entries received determines the odds of winning.

8. Selection and Notification of Winner: The Winner will be selected by a random drawing under the supervision of the Sponsor. The Sponsor will notify the Winner by direct message within five (5) days following Winner selection. The Winner will also be announced on LinkedIn, Instagram, Facebook, and Twitter on October 15, 2021, provided, however, that Sponsor reserves the right to determine an alternate method of notification. The Sponsor is not responsible for nor shall have no liability for Winner’s failure to receive notices. Nor shall the Sponsor be liable for the Winner’s provision of incorrect or otherwise non-functioning contact information. If the Winner 1) fails to claim the Prize within 7 days from the time the award notification was sent, 2) is found ineligible, or 3) does not complete and return an executed declaration and release within the specified timeframe, the Prize may be forfeited and an alternate Winner may be selected. Receipt of the Prize offered in the VP Smooth Parts Sweepstakes by the Winner is upon the condition of compliance with any and all federal, state, and local laws and regulations. IF THE WINNER VIOLATES ANY OF THESE OFFICIAL RULES, THE WINNER (AT THE SPONSOR’S SOLE DISCRETION) WILL BE DISQUALIFIED, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

9. Rights Granted by You: By submitting an Entry into this Sweepstakes, You understand and agree that the Sponsor, any individual acting on the Sponsor’s behalf, and the licensees successors, and assigns of the Sponsor shall, where permitted by law, have the right to print, publish, broadcast, distribute and use in any media known now or hereafter developed, in perpetuity, worldwide, and without limitation, your submission, name, photo, portrait, voice, likeness, image, statements about the VP Smooth Parts Sweepstakes, and your biographical information for news, publicity, advertising, promotional purposes, trade, information, and public relations without any further notice, review, consent, compensation, or remuneration.

10. Additional Terms & Conditions: In its sole discretion, the Sponsor reserves the right to modify, suspend, cancel, or terminate the VP Smooth Parts Sweepstakes should non-authorized human intervention, a bug or virus, fraud, or other causes beyond the Sponsor’s control, impact or corrupt the security, fairness, proper conduct, or administration of the VP Smooth Parts Sweepstakes. The Sponsor, in the event of any of the above issues, may determine the Winner based on all eligible entries received prior to and/or after (if appropriate) the action taken by the Sponsor. Individuals who tamper with or attempt to tamper with the operation or entry process of the Sweepstakes or website or violate these Official Rules will be disqualified by the Sponsor in its sole discretion. In its sole discretion, the Sponsor has the right to maintain the integrity of the VP Smooth Parts Sweepstakes, to void votes for any reason, including, but not limited to: identify any disallowed entry methods that will result in votes/entries being voided; examples: multiple entries from the same user; multiple entries from the same computer beyond the number allowed by the Sweepstakes rules; or the use of bots, macros, scripts, or other technical means for entering.]Attempts by any entrant to deliberately damage any website or undermine the legitimate operation of the VP Smooth Parts Sweepstakes may be a violation of criminal and civil laws. If any such attempt is made, the Sponsor reserves the right to seek damages to the fullest extent permitted by law. When applicable, the Winner may be required to execute and return (and winning may be conditioned upon the Winner executing and returning) to Sponsor, within two (2) weeks, an Affidavit of Eligibility and a Liability and Publicity Release drafted by Sponsor to be eligible for the Prize, or an alternate Winner may be selected. The Winner may be required in Sponsor’s sole discretion to complete relevant tax forms as a condition to the delivery of the applicable Prize. Winner may also be required to furnish proof of identity, address, and birth date in order to receive a Prize.

11. Limitation of Liability: Your entry into this Sweepstakes constitutes Your agreement to release and hold harmless the Sponsor and its subsidiaries, representatives, affiliates, partners, advertising and promotion agencies, successors, agents, assigns, directors, employees, and officers against and from any and all claims, liability, illness, injury, death, litigation, loss, or damages that may occur, directly or indirectly from participation in the Sweepstakes and/or the 1) Winner accepting, possessing, using, or misusing of any awarded prize or any portion thereof; 2) any type of technical failure; 3) the unavailability or inaccessibility of any transmissions, phone, or Internet service; 4) unauthorized intervention in any part of the entry process or the Promotion; 5) electronic error or human error in the Promotion administration or the processing of entries.

12. Disputes: THIS SWEEPSTAKES IS GOVERNED BY THE LAWS OF THE UNITED STATES OF AMERICA AND THE STATE OF NEW YORK, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. The Entrant agrees, as a condition of participating in this Sweepstakes, that all disputes arising under the Sweepstakes shall be governed by and interpreted in accordance with the laws of New York, without regard to principles of conflict of laws. All disputes arising under the Sweepstakes will be submitted to arbitration in New York City, NY before a single arbitrator of the American Arbitration Association (the “AAA”). The arbitrator shall be selected by application of the rules of the AAA, or by mutual agreement of the parties, except that such arbitrator shall be an attorney admitted to practice law in New York.  As condition for participating in the Sweepstakes, no Entrant shall challenge the jurisdiction or venue provisions as provided in this section.  Under no circumstances in any such dispute shall the participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Sweepstakes. The participant waives all rights to have damages multiplied or increased. THE PRIZES ARE AWARDED “AS IS” AND SPONSOR DOES NOT MAKE ANY, AND HEREBY DISCLAIMS ANY AND ALL, REPRESENTATIONS OR WARRANTIES OF ANY KIND REGARDING THE PRIZES. NOTWITHSTANDING ANYTHING ELSE HEREIN OR OTHERWISE, SPONSOR, INCLUDING JUDGES, AGENTS, REPRESENTATIVES, AFFILIATES, AND/OR ITS VENDORS SHALL NOT BE LIABLE OR OBLIGATED WITH RESPECT TO ANY SUBJECT MATTER OF THIS AGREEMENT OR UNDER CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHER LEGAL OR EQUITABLE THEORY FOR (A) ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES (INCLUDING, WITHOUT LIMITATION, LOSS OF REVENUE, GOODWILL, OR ANTICIPATED PROFITS); (B) DATA LOSS OR COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; AND/OR (C) ANY MATTER BEYOND SUCH PARTIES’ REASONABLE CONTROL.

14. Winners List: Beginning on or about October 15, 2021, the Winner will be announced on LinkedIn, Instagram, Facebook, and Twitter.

15. Social Media Channel-Specific Rules

The Sweepstakes hosted by Shapeways is in no way sponsored, endorsed, administered by, or associated with LinkedIn, Instagram, Facebook, or Twitter.

Any attempt by you to obtain more than the stated number of entries by using multiple and/or different identities, accounts, registrations, email addresses, logins or any other methods will void that participant’s entries, and that participant may be disqualified at Sponsor’s discretion.
