Varsity Brands<\/em>, destined to be known as &#8220;the cheerleader uniform case.&#8221; \u00a0 On its face, the case is focused on the somewhat metaphysical question of when a tennis skirt and tank top cross the line into being a cheerleader uniform.<\/p>\n<p>However, as we&#8217;ve <a href=\"https:\/\/www.shapeways.com\/blog\/archives\/21948-q-what-brings-cheerleaders-and-3d-printing-together.html\" target=\"_blank\">written about before<\/a>, the real question in the case is how copyright should apply to works that mix creative and functional elements. \u00a0Copyright protects creative works but not functional works, so drawing that line can be incredibly important. \u00a0Unfortunately, currently there are at least 10 different (somewhat conflicting) tests that try and guide the analysis.<\/p>\n<p>Earlier this year Sydney Lakin and Bill Koch at Stanford Law School\u2019s\u00a0<a href=\"https:\/\/law.stanford.edu\/juelsgaard-intellectual-property-and-innovation-clinic\/\" target=\"_blank\">Juelsgaard IP and Innovation Clinic<\/a>\u00a0helped us, along with <a href=\"http:\/\/formlabs.com\/\" target=\"_blank\">Formlabs<\/a> and <a href=\"https:\/\/matterandform.net\/\" target=\"_blank\">Matter and Form<\/a>, <a href=\"https:\/\/www.shapeways.com\/blog\/archives\/23650-asking-for-clear-rules-on-copyright-and-3d-printed-objects.html\" target=\"_blank\">ask the Supreme Court<\/a> to step in and pick one definitive test.<\/p>\n<p>Why do we care so much? \u00a0Many 3D printed objects combine both functional and design elements. \u00a0Understanding if &#8211; and how &#8211; copyright applies to them is the first step in understanding licensing, use, and many other aspects of those objects.<\/p>\n<p>We don&#8217;t know when the case will be heard yet (although we are sure it won&#8217;t be until after the summer). \u00a0We&#8217;ll be sure to keep you up to date on the developments as they come out. \u00a0In the meantime, if you have any questions feel free to leave them in the comments or tweet them to <a href=\"https:\/\/twitter.com\/mweinberg2D\/\" target=\"_blank\">@MWeinberg2D<\/a>.<\/p>\n<p>&nbsp;<\/p>\n<p><em>Image courtesy\u00a0<a href=\"http:\/\/www.petful.com\/\" target=\"_blank\">petful<\/a>.<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Monday, the U.S. Supreme Court announced that it would be considering Star Althletica v.
